Freedom of association / Right to organize

Freedom of association :

The 2008 Constitution guarantees the right to form trade unions and to participate in their activities. The main labour law, the Employment Act of 2008, does not regulate workers' collective rights such as the right to collective bargaining and the right to strike.
Anti-Union discrimination:
- >The law does not specifically protect workers from anti-union discrimination.
The Employment Act of 2008 merely stipulates that membership of a trade union or involvement in any lawful activity conducted by such an association shall not constitute a reasonable ground for dismissal.
Restrictions
Categories of workers prohibited or limited in law from forming or joining a union, or from holding a union office:

- The Constitution stipulates that members of the Military Service shall not affiliate with any trade union.
- >Police
- According to the Constitution, members of the Police Service shall not affiliate with any trade union.
Right to collective bargaining

While there is no explicit right to collective bargaining, article 30(b)(2) of the Constitution, which guarantees the right to participate in trade union activities, could be read as encompassing such a right.
